Ongoing patent dispute between OEM and Zinyaw LLC d/b/a TonerPirate.com (TonerPirate) resolved.
WhatTheyThink reports that Canon has settled with another aftermarket company in its ongoing patent infringement case regarding “certain toner cartridges and photosensitive drums, including any toner cartridges containing such photosensitive drums”.
The patent infringement case was first taken up by Canon against some 32 aftermarket companies in January 2012, with TonerPirate being the latest to reach a resolution with the OEM.
The settlement sees TonerPirate stipulating to a Consent Judgement and Permanent Injunction from the Southern District of New York, prohibiting it from making, using, selling or importing the involved toner cartridges into the US. TonerPirate will also pay Canon an undisclosed sum as part of the settlement.
The Recycler has followed the patent case over the past year, reporting on a number of other settlements between Canon and the accused aftermarket companies, including Green Project and Clover, both of which settled in October last year, and Onlinetechstores.com which settled in May.
