Canon announces 4th quarter Amazon tally and further removals

The OEM has announced the listing removals for the fourth quarter of 2021 and that it requested the removal of toner cartridges offered by zhu hai chuang yue xin ke ji you xian gong si via Amazon Germany.

Canon Inc. announced that in the fourth quarter of 2021, it has used the Amazon Reporting Tool, letters of inquiry and/or information letters to successfully remove 2,224 listings from Amazon in Germany, Italy, Spain, the United Kingdom, France, The Netherlands and Turkey.

Since June 2018, the total number of listings removed from Amazon in Germany, Italy, Spain, the United Kingdom, France, The Netherlands and Turkey is 26,306.

The listings offered third-party laser toner cartridges from vendors which Canon believes infringed one or more of European Patent No.2 087 407, European Patent No. 2 137 577 ,European Patent No. 1 977 289, European Patent 3 470 931 and European Patent No.3 270 230.

The OEM also announced that in the fourth quarter of 2021, it has used Amazon takedown procedures to report infringement based on 57 listings, all of which now have been removed from Amazon in Canada, Mexico and the United States of America.

Since June 2018, the total number of listings removed from Amazon in Canada, Mexico and the United States of America is 3,216.

The listings offered third-party laser toner cartridges from vendors, which Canon believes infringed one or more of U.S. Patent No. 8,280,278, U.S. Patent No. 8,630,564, U.S. Patent No. 8,682,215, U.S. Patent No. 8,688,008, U.S. Patent No. 8,676,090, U.S. Patent No. 8,588,646, U.S. Patent. No. 9,581,958, Canadian Patent No. 2,635,791, Canadian Patent No. 2,910,527, Mexican Patent No. 308881 and Mexican Patent No. 317598.

Furthermore, Canon reported that it filed an Infringement Report Form with Amazon.de based on the alleged use of claim 1 of the German portion of Canon’s European Patent EP 3 270 230 (“EP ‘230”) regarding certain toner cartridges offered by zhu hai chuang yue xin ke ji you xian gong si under the following ASIN (Amazon Standard Identification Number).

The reported cartridges are intended for use in HP printers and compatible with OEM HP cartridges. The cartridges contain new – non-OEM – components, including the housing of the first and second unit, the urging portion and the force receiving portion according to claim 1 EP ‘230.

As a result of the Infringement Reports, Amazon removed the respective cartridge offers.
